SMS / Text Messaging Terms & Conditions

By opting in to receive SMS/text messages from The Denver Foundation, you agree to the terms outlined below and to the practices described in our Privacy Policy. 

 

  1. Program Description

The Denver Foundation provides one-to-one SMS text messaging to support direct, person-to-person communication between our staff and individuals we serve. Messages may include communication related to: 

  • Programs and services 
  • Event coordination and reminders 
  • Scheduling and meeting follow-ups 
  • General operational or relationship-based correspondence 

Messages are manually sent by staff through Microsoft Teams and are NOT automated, promotional, or mass marketing in nature. 

 

  1. Consent to Receive Messages

By submitting your mobile phone number and opting in, you explicitly consent to receive one-to-one SMS text messages from The Denver Foundation. 
Providing consent to receive SMS messages is not a condition of participation in any program or service. 

 

  1. Message Frequency

Message frequency varies based on your interaction with The Denver Foundation, its team members, and the nature of the communication. Messages are sent only when relevant to your relationship with our organization. 

 

  1. Message & Data Rates

Message and data rates may apply depending on your mobile carrier and service plan. Please contact your wireless provider for details. 

 

  1. Opt-Out Instructions

You may opt out of SMS messages at any time by replying: 

  • STOP 

After opting out, you will receive a confirmation message, and no further SMS messages will be sent unless you opt in again.

  1. Privacy & Data Use

The Denver Foundation and its members respect your privacy. We collect and use mobile phone numbers solely for one-to-one SMS communication related to organizational operations and services. 

  • Data collected: Mobile phone number and SMS message content 
  • Use: Direct communication between staff and individuals 
  • Retention: Messages are retained within Microsoft Teams for internal record-keeping and continuity 
  • Sharing: We do not sell or share mobile numbers for marketing purposes

  1. Carrier Liability & Service Interruptions

Wireless carriers and service providers are not liable for delayed, undelivered, or failed messages. Delivery is subject to network availability and device compatibility. 

 

  1. Changes to These Terms

We may update these SMS Terms & Conditions from time to time. Updates will be posted on our website. Continued participation in the SMS program constitutes acceptance of any changes. 

 

  1. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.
